DA’s office to continue protest of woman’s parole consideration

District Attorney Cathy Stocker said her office will continue its protest of a woman who was passed this month to a second stage for parole consideration at this month’s meeting of the state Pardon and Parole Board.

“Over our objection the Pardon and Parole Board voted to pass Kea T. Kimbro to the second stage of consideration reserved for violent offenders and I intend to send a representative to the next docket to protest the possibility of her release,” Stocker said.

In January of 2004, Kimbro, who has previous felony convictions for assault and battery with a dangerous weapon and possession of controlled dangerous substance, pulled a knife during an argument with one person and then cut another person on the cheek with the knife.

“As a result, she was charged with assault with a dangerous weapon and assault and battery with a dangerous weapon,” Stocker said. “She was sentenced in October 2004 to serve 12 years for each offense, with the sentences to run concurrently.”

Of the remaining 18 offenders on this month’s docket, 13 were denied parole, three were recommended for parole to the street and two were recommended either for parole to a detainer or to the street.

All violent offenders other than Kimbro, including Terry Sitting who is serving life sentences for two murders in Garfield County, were denied parole outright.

“Not surprisingly, four of the five offenders receiving favorable consideration are in prison for drug offenses while the fifth is in prison for a combination of drug and other non-violent offenses,” Stocker said.

Garfield County offenders receiving a favorable recommendation for parole to the street are Tracy Atchley, in prison for attempted manufacture of CDS, and Mark McVickers, in prison for two counts of possession of CDS with intent to distribute, possession of a substance with intent to manufacture CDS, possession of a CDS within 1,000 feet of a school, two counts of unlawful use of a police radio, and a count of unlawful possession of a police radio, all after former conviction of two felonies. Canadian County offender Eduardo Daniel, in prison for trafficking in illegal drugs, also was recommended for a parole to the street.

The two offenders recommended for parole to a detainer or to the street are Garfield County’s Jessica Gunter, in prison for possession of CDS with intent to distribute with a detainer from Missouri for distribution/delivery of a controlled substance, and Blaine County’s Roger Stephens, in prison for possession of CDS without a valid prescription with a detainer from Major County for possession of firearm, after former conviction of a felony.
