A judge ordered a mental competency examination for a Waukomis man charged with indecent exposure.
Special District Judge Paul Woodward ordered Allen Patrick Aguiar to undergo the exam following his arraignment Thursday on the felony charge, which is punishable by 30 days to 10 years imprisonment, a fine of $500 to $20,000 or both.
Aguiar, 55, appeared before the judge in person with his mother and father Thursday morning. The judge asked Aguiar if he understood the charges but did not get an immediate response.
After speaking with Aguiar’s parents at the bench, Woodward ordered the evaluation.
According to an affidavit filed in the case, Waukomis police received a report about 2:43 p.m. Tuesday about a man who was in the 200 block of West Tyrone exposing himself.
Waukomis police spoke with a woman who said she saw the man standing by a tree in her backyard exposing himself.
Police located the man, identified as Aguiar, in the 300 block of West Euclid. Police had trouble obtaining information from him. When police spoke with Aguiar’s parents, they said Aguiar has the mental functions of a 9-year-old.
When asked by police if he had exposed himself, Aguiar nodded his head yes.
Aguiar is free on a $5,000 recognizance bond and was ordered to return to court Dec. 14 for a bond appearance.
