An Enid man is facing felony charges for allegedly driving under the influence two days after pleading to a similar charge in a southern Oklahoma county.
Daniel Robert Mendoza, 23, was arraigned Thursday on charges of felony driving under the influence of alcohol subsequent offense and leaving the scene of an accident involving damage, a misdemeanor.
The charges allege Mendoza was driving a 1998 Chevy Tahoe Sept. 16 in the 100 block of West Elm and struck a parked vehicle.
Online court records show Mendoza pleaded guilty Sept. 14 to driving a motor vehicle under the influence of alcohol in Stephens County, receiving a one-year suspended sentence.
According to an affidavit filed in the case, Enid police responded about 1:50 a.m. Sept. 16 in reference to an accident involving three vehicles.
Police spoke with the owner of Downtown Auto-plex, who said his tow truck and two others vehicles had been struck by an unknown vehicle, the affidavit states.
Police located a white Chevy Tahoe in an alleyway in the 300 block of North Grand that had damage similar to that caused to the three vehicles, according to the affidavit. Police also saw a Dodge Neon parked next to the Tahoe with its lights off, but the car left the area after police arrived. Police ran the tag of the Tahoe, which checked back to Mendoza.
Police spoke with Men-doza at 412 W. Oak, where the same Dodge Neon was parked, according to the affidavit. When asked by police, Mendoza said he was the one who was driving the Tahoe.
He told police he left Buffalo Wild Wings and was driving to a friend’s house. When in the area of the Downtown Autoplex Men-doza said he hit the arm of the tow truck, which caused his vehicle to veer to the right and strike two other vehicles, according to the affidavit.
Police asked Mendoza how much he had to drink while at the restaurant, and he said about seven 24-ounce glasses of beer, the affidavit states. He said he intended to contact the owner of the vehicles in the morning. He admitted to police he did not contact them about the accidents because he had been drinking.
Police asked Mendoza if he had been arrested for DUI before and he replied yes, three other times, according to the affidavit. Police then placed him under arrest.
During booking, Mendoza agreed to submit to the state’s breath test. The first test resulted as 0.09 and the second resulted as 0.10, according to the affidavit.
Mendoza faces one to five years in prison and a fine of up to $2,500 on the DUI charge and up to a year in prison, a fine of up to $500 or both on the charge of leaving the scene of an accident.
He is free on $20,000 bond and was ordered to return to court Nov. 16 for a bond appearance.
