Three people are facing federal charges stemming from the sale of herbal incense at a Woodward business, according to U.S. Attorney Sanford C. Coats, who represents the Western District of Oklahoma.

The indictments were returned Wednesday by a federal grand jury in Oklahoma City, and were announced Thursday by Coats’ office.

Tracy Lynn Daniels faces 28 counts, one of conspiracy, 22 counts of knowingly engaging in monetary transactions affecting interstate commerce and five counts of knowingly structuring and assisting in structuring for the purpose of evading reporting requirements.

Adam Dale Daniels faces one count of conspiracy and one count of knowingly and intentionally distributing controlled substance analogue.

Chelsea Amber Cook faces two counts of knowingly and intentionally distributing controlled substance analogue and one count of knowingly and intentionally selling drug paraphernalia.

Tracy Daniels faces up to 20 years in prison, a $1 million fine, or both, on the conspiracy charge and up to 10 years in prison, a $250,000 fine, or both, on each of the 23 other counts.

Adam Daniels faces up to 20 years in prison, a $1 million fine, or both, on both of the charges he is facing.

Chelsea Cook faces up to 20 years in prison, a $1 million fine, or both, on the two counts of distributing controlled substance analogue and up to three years in prison or a $250,000 fine on the drug paraphernalia charge.

Tracy Daniels and Adam Daniels owned the gift shop Sugar Lips in Woodward, according the U.S. Attorney’s Office. Cook worked at Sugar Lips.

According to the indictment, “The primary business of Sugar Lips was the sale of what is identified as herbal incense ... The packaging for the products states that they are not for human consumption.”

The indictment further states, “The herbal incense products, in fact, are substances that have a chemical structure substantially similar to the chemical structure of controlled substances, including marijuana, and which have similar effects on the central nervous system. Sugar Lips sold the herbal incense to be smoked to get high.”

The 22 counts of knowingly engaging in monetary transactions affecting interstate commerce Tracy Daniels faces involve “monetary transactions, through or to a financial institution ...” each of more than $10,000 from Nov. 23, 2010, to Feb. 7, 2012.

The five counts of knowingly structuring and assisting in structuring for the purpose of evading reporting requirements Tracy Daniels is facing, involve cash deposits of between $6,000 and $9,995 from June 7, 2011, to April 10, 2012.

According to Coats’ office, if they are found guilty they will forfeit any property involved in the charges, including approximately $37,237.29 in cash; property at 806 Main Street in Woodward; a 2011 Tracker Nitro Z7 boat; a 2011 Mercury Marine 150L motor; a 2011 Tracker Marine trailer; and five boxes of assorted drug paraphernalia.
